The petitioners apprehend their arrest in Maner P.S. case No. 293 of 2016 under Section 307 and some other Sections of the Indian Penal Code.
The informant named both the petitioners and alleged that they entered into his house, assaulted the informant, his son, Ravi Kumar, and wife, Rita Devi. They all got serious injuries. A Panchayati was also held but the petitioners did not obey the decision of the panches.
The learned counsel for the petitioners submits that petitioners are own brothers of the informant. There is land dispute between both sides. The informant alleged that petitioners
Patna High Court Cr.Misc. No.8057 of 2017 (7) dt.23-05-2017 2/2 assaulted the informant, his son and wife but from perusal of the injury report, it would appear that the injuries are simple in nature and caused on account of some minor scuffle.
Considering the facts that petitioners are own brother of the informant and on account of land dispute own brothers are fighting with each other and the informant and his family members got simple injuries, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Danapur, Patna in Maner P.S. Case No. 293 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
