1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Murliganj P.S. Case no. 200 of 2023 registered under sections 302, 341, 342, 386, 120B, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, the informant states that as a result of firing resorted to by the accused Sunil Verma, Anil Yadav, Bauwa Yadav and Nitish Kumar her husband sustained gunshot injury and died. Other accused persons including the petitioner herein worked as a liner.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of his antecedents. He was neither named in the FIR nor arrested at the spot. His name transpired in the

Patna High Court CR. MISC. No.47308 of 2024(3) dt.30-08-2024 2/2 confessional statement of coaccused Nisthu Kumar @ Bauwa Yadav. The petitioner is in custody since 23.4.2024.

5. Heard learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R. being specific against the accused mentioned therein, the petitioner not having been named as accused in the FIR, his name transpiring in the confessional statement of coaccused made before the police, the petitioner being in custody since 23.4.2024 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Murliganj P.S. Case no. 200 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Madhepura.
