Perused the order dated 08.02.2016 passed by Subordinate Judge-XII, Muzaffarpur in Title Suit No.115 of 2005. In view of the finding recorded by the court below it cannot be said that the order passed by the court below is without jurisdiction or that in the manner not permitted by law or that it occasioned failure of justice. The dispute raised by the defendant against defendant no.7 is inter-se dispute between the defendants that cannot be decided in this suit which has been filed by the plaintiff. Therefore, I find no reason to interfere with the impugned order in exercise of supervisory jurisdiction.
