The petitioner has prayed for bail in a case registered for the offence punishable under sections 363, 365 of the Indian Penal Code.

As per allegation in the FIR, on 4.3.2021 at about 7:PM, son of the informant was sitting at his door and after 1015 minutes, he went missing and still traceless. It is submitted by learned counsel for the petitioner that petitioner is not named in the FIR. During course of investigation, his name transpired in confessional statement of Krishna Yadav. Save and except suspicion, no other material has come to show his involvement in the alleged crime. Similarly

Patna High Court CR. MISC. No.45840 of 2022(3) dt.11-01-2023 2/2 situated other co-accused persons have already been granted regular bail vide order dated 19.5.2022 passed in Cr. Misc. No. 58481/2021 and order dated 10.05.2022 passed in Cr. Misc. No. 64427 of 2021. Petitioner is languishing in judicial custody since 01.06.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM, Mahrajaganj, Siwan in connection with Maharajaganj P.S. Case No. 64 of 2021.
