JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Barun P.S. Case No. 192 of 2017, registered for offences punishable under Sections 379, 411, 420 and 34 of the Indian Penal Code and under Sections 3/4/54 of Bihar Illegal Mining Act and also under Sections 75/80 B.M.M.C.R.

The allegation against the petitioner is of illegally loaded the sand on his tractor.

Submission of the learned counsel for the petitioner is that he is the owner and he was not present at the place of occurrence and the sand is loaded by another person. Heard learned APP also.

Having heard both sides and in view of the facts and

No.30064 of 2018 (4) dt.26-06-2018 2/2 circumstances, as stated above, let the petitioner, above named, in the event of his arrest or surrender be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No. 192 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that in future, if he involved in such type of cases, his bail bond shall be cancelled.
