The petitioner is apprehending his arrest in Complaint Case No.2353/14 registered for the offence under Sections 498(A) of I.P.C.
Accusation is of torturing of the complainant by her husband and other in-laws due to non-fulfillment of dowry demand of Rs.50,000/- and ousting her from her matrimonial house snatching her belongings.
Learned counsel for the petitioner submits that the petitioner is the husband of the complainant and he always tried to keep his wife, O.P.No.2, but she does not want to live with him. She has filed Matrimonial (R.C.R.) Case No.228/14 under Section
Patna High Court Cr.Misc. No.14367 of 2017 (4) dt.08-08-2017 2/2 9 of the Hindu Marriage Act in which she did not appear and the same was decreed ex-party on 25.07.2015 by Principal Judge, Family Court, Saran at Chapra. He further submits that the petitioner is still ready to keep her with him as wife with full dignity and honour.
Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-with two sureties of the like amount each to the satisfaction of S.D.J.M., Saran at Chapra, in Complaint Case No.2353/14, Trial No.2785/16 subject to the conditions as laid down under Section 438(2) Cr.P.C.
