The petitioner has preferred this application for grant of regular bail in a case registered under sections 308, 147, 148, 323, 324, 379, 504 and 506 of the Indian Penal Code. As per the prosecution case, the ten named accused persons including the petitioner herein are said to have come variously armed. It is further stated that Gulab Kumar assaulted Ranjeet Kumar with the butt of a pistol while Manish Kumar assaulted him with a garasa causing injuries on his head. Thereafter, all the accused persons also assaulted him. Further Kumar Abhishek is said to have assaulted Shashi Bhushan Kumar.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The
Patna High Court CR. MISC. No.55593 of 2021(2) dt.05-04-2022 2/2 specific allegation of assault is on Gulab Kumar and Manish Kumar and not the petitioner herein. The petitioner is simply said to be a member of the mob and he is in custody since 26.6.2021. He has no criminal antecedent and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, there being no specific allegation against the petitioner of assault together with the petitioner having remained in custody for 9 months and charge sheet having been submitted, the Court directs the petitioner to be enlarged on bail in connection with Wazirganj P.S. Case no. 231 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-I, Gaya. (Partha Sarthy, J) Prakash/- U
