JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-06-2021 Heard Mr. Bijay Bhushan Prasad, the learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Excise G.R. No.216 of 2020 arising out of Excise Case No.218 of 2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

For the recovery of 27 litres of liquor from the fodder house of the petitioner, I am not inclined to grant anticipatory bail to him.

The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the Court below and seeks bail, the Court below shall consider the

Patna High Court CR. MISC. No.40694 of 2020(2) dt.22-06-2021 2/2 case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
