The learned counsel for the petitioners submits that in the modification application and in prayer portion, there is some mistake and the learned counsel for the petitioners wants to correct the same during the course of the date.
Let the same be corrected by the learned counsel for the petitioners.
This criminal miscellaneous application has been filed for modification of the order dated 24.3.2017 by submitting that the father's name of the accused nos. 2 and 3 were typed wrongly in the bail petition and, accordingly, in the order dated 24.3.2017, village name of the petitioner nos. 1,3 and 4 has also been typed
Patna High Court Cr.Misc. No.20086 of 2017 (2) dt.10-05-2017 2/2 wrongly and as such the order be modified accordingly. It is submitted that the name of petitioner no.2 may be corrected as Md. Naushad Alam son of Md. Inamul, petitioner no.3 may be corrected as Ishrar Alam son of late Hasib and resident of village of petitioner nos. 1,3 and 4 may be corrected as village- Bansbari in place of village Rampur, Tola Damhail. In the facts and circumstances, stated above, considering the typographical mistake in the bail petition, the modification application is hereby allowed and the name of petitioner no.2 be read as "Md. Naushad Alam son of Md. Inamul, name of petitioner no.3 be read as Ishrar Alam son of late Hasib and the village of petitioner nos. 1,3 and 4 may be read as "Bansbari".
Accordingly, this modification petition is hereby allowed.
The petitioners, under the circumstances, are directed to surrender within two weeks from the date of receipt/ production of a copy of this order and then the petitioners shall be released on bail as per the terms and conditions in the earlier order. (Jitendra Mohan Sharma, J) BTiwary/- U T
