JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-02-2017 This is an application for grant of anticipatory bail for offences punishable under Section 498A of the Indian Penal Code.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that in this case there is allegation under Section 498A of the Indian Penal Code. A compromise has been arrived at between the parties in the learned court below itself but inspite of that the anticipatory bail of the petitioner was rejected and petitioner has been asked to pay Rs. 1,500/- per month regularly to the complainant. .

Patna High Court Cr.Misc. No.7539 of 2017 (2) dt.23-02-2017 2/2 Heard learned A.P.P. as well as learned counsel for the complainant. Learned counsel for the complainant has also admitted that she is ready to live separately, if maintenance amount of Rs.1,500/- is paid to her regularly. Considering the submissions of the parties, petitioner is directed to surrender in the court below (Chief Judicial Magistrate, Sheikhpura) in connection with Complaint Case no. 202C of 2016 and make prayer for regular bail and also give an undertaking that he will pay Rs.1,500/- per month to the complainant regularly. Thereafter, petitioner will be released on provisional bail to the satisfaction of the court below and court below will watch the conduct of the petitioner for the next six months and if the court below finds the conduct of the petitioner satisfactory, then bail bond of the petitioner shall be confirmed, otherwise learned court below will be at liberty to pass an order what he thinks fit and proper.

The present application accordingly stands disposed of.
