JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-08-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). A direction may be given to the respondents no. 3 to 6 for removal of the encroachment upon the Government Nala and the road (Pathway) for the respondent no.7 i.e. Ramlal Tiwari of Village Chanaur, P.S.- Bihiyan, District- Bhojpur at Ara upon the land of Khata No. 25, Survey plot no. 70 & 71 Area 7 decimals, has been illegally encroached. The said Nala is the very old Nala of the village.
Patna High Court CWJC No.10166 of 2024(2) dt.06-08-2024 2/2 (ii) And further direction may be given to the respondent no.6 i.e. the Circle Officer, Shahpur, District- Bhojpur at Ara for measurement of the land of Khata No. 25, Survey plot no. 70 & 71 Area 7 decimals of Mauza- Jhanwan, Thana No.
85, Anchal- Shahpur, District- Bhojpur at Ara for full and final settlement of the dispute of the Nala and Pathway of the village."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the Respondent No. 3 i.e. the District Magistrate, Bhojpur at Ara, for redressal of his aforesaid grievances. Liberty, so sought, is granted.
