The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 379, 307, 427, 506/34 of the Indian Penal Code.

The prosecution case is that in the background of land dispute informant's nephew Laldhar Mehta, petitioner no. 1, Ashok Mehta, Binod Mehta started quarrelling with the informant for removing Katghara and in the meantime the petitioner no. 2 Manju Devi and petitioner no. 3 Anita Devi raised alarm, upon which 2-4 unknown persons came, damaged the katghara and took away sale proceeds of Rs. 5,000/-. Petitioner no. 1

Patna High Court Cr.Misc. No.16591 of 2016 (2) dt.18-04-2016 Laldhar Mehta assaulted the informant with farsa on his head and Ashok assaulted the informant with sword and threatened to flee away otherwise he would be killed and further the female members of petitioner no. 1's family Laldhar Mehta assaulted to Umda Devi and Sunita Devi with sickle and iron rod.

It is submitted by the learned counsel for the petitioners that in the background of land dispute accusation has been levelled. There is counter version of the occurrence. Both sides have received injuries. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned J.M., Ist Class, Madhepura in connection with Shree Nagar P.S. Case No. 60 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
