The petitioners apprehend their arrest in Ghanshyampur P.S. Case No. 145 of 2013 instituted for the offence under sections 147, 341, 323, 353 and 188 of the Indian Penal Code.
There is allegation that during course of proceeding under section 144 Cr.P.C. on the disputed land, the petitioners started construction work and when the informant (Choukidar) raised protest then he was pushed by the petitioners. Under such circumstances, there is land dispute between the parties. There is general and omnibus allegation
Patna High Court Cr.Misc. No.9640 of 2017 (2) dt.08-03-2017 2/2 levelled against these petitioners.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners named above, within six weeks from today, in connection with Ghanshyampur P.S. Case No. 145 of 2013, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Biraul, Darbhanga, subject to the conditions as laid down under Section 438(2) Cr.P.C.
