The petitioner apprehends his arrest in connection with Bagaha (Pathkhauli) P.S. Case No. 417 of 2018, registered under Section 295(A) of the Indian Penal Code and Sections 66 and 67 of the Information & Technology Act, (I.T.Act). The accusation is that on 16.08.2018 at Golamber near the State Bank of India, Bagha, by putting the dead body of son of Banarasi Chaudhary, the people blocked the road and damaged the vehicles and shops situated nearby the Golamber and the mob also attacked the police force but anyhow the informant and other police personnel removed the blocked road. Regarding the aforesaid occurrence, Bagaha (Pathkhauli) P.S.

Patna High Court CR. MISC. No.42244 of 2019(2) dt.09-07-2019 2/2 Case No. 415 of 2018 was instituted. Thereafter, regarding the aforesaid occurrence, one Arun Kumar Pathak made comment on social media damaging the prestige of police administration and disturbing the communal harmony and petitioner, Sunil Mistri and Nippu Kumar Singh also made comment on social media disturbing the communal harmony.

Learned counsel for the petitioner submits that petitioner, who is the businessman, has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-Ist, Bagaha, West Champaran, in connection with Bagaha (Pathkhauli) P.S. Case No. 417 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
