The petitioners seek bail in Bheja P.S. Case No. 33 of 2018, instituted for the offence under Section (s) 147, 148, 149, 341, 323, 324, 325, 354, 448, 307, 302 and 504 of the Indian Penal Code.

Counsel for the petitioners submits that there is general and omnibus allegation against the petitioners. In the written report there is specific allegation against Ram Narayan Mukhiya, Bhola and Amar of causing injury to the husband of

Patna High Court CR. MISC. No.44940 of 2019(2) dt.24-07-2019 2/2 the informant with Farsa, Khanti, Dabiya etc., on account of which he sustained injury and subsequently died. Counsel for the petitioners further submits that other co-accused persons have already been granted bail by coordinate Benches of this Court vide orders dated 4.12.2018, 10.9.2018, 26.9.2018 and 20.02.2019 passed in Cr. Misc. 70281 of 2018, 43945 of 2018, 47739 of 2018 and 75103 of 2018 with 75809 of 2018 respectively.

Petitioners are in custody since 8.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani, in connection with Bheja P.S. Case No. 33 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioners.
