The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 373 of 2019, registered for the offence punishable under Section 395 of the Indian Penal Code.
As per the FIR, 10-12 persons armed with Katta committed robbery in the house of informant and took away gold, silver ornaments, cash and watches.
It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Gautam Kumar who has already been granted bail by this Court vide order dated 02.02.2021 passed in Cr. Misc. No. 37130 of 2020. No looted article has been recovered from possession of this
Patna High Court CR. MISC. No.54615 of 2021(2) dt.21-02-2022 2/2 petitioner. No test identification parade has been held till date. Petitioner is in custody since 05.12.2020.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 373 of 2019.
