JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2018 The petitioner is apprehending his arrest in connection with Chautham P.S. Case No. 182/2017, registered for offences punishable under Sections 406, 409, 420, 467, 468 and 471/34 of the Indian Penal Code.
Petitioner is panchayat secretary and allegation against him that he in connivance with mukhiya misappropriated an amount of Rs. 17,28,000/- by withdrawing the same and committed financial irregularity.
It has been submitted on behalf of the petitioner that it is not a case of embezzlement rather there is delay in the execution of scheme and in fact the work of construction of Aanganwadi Kendra is going on, which will be completed in near future. Heard learned A.P.P. also.

No.10549 of 2018 (4) dt.02-05-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender in the court below within a period of four weeks and on his surrender the court below shall release the petitioner on bail to his own satisfaction, till submission of charge-sheet and once charge-sheet is submitted and if the case is found true, the petitioner has to surrender before the court below and pray for regular bail, which will be considered by the court below on the basis of materials available at that time.
