JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 420 and other ancillary sections of the Indian Penal Code. As per the prosecution case, this petitioner along with other accused person have taken loan of Rs.3.5 lacs for purchasing tractor from Madhya Bihar Gramin Bank, Nawda but be has not paid the loan amount and not even returned the tractor.
Learned counsel for the petitioner submits that the petitioner is ready to deposit the aforesaid loan amount to the bank within six months in three equal instalments. Considering the undertaking given by learned counsel for the petitioner, let the petitioner as named above, be enlarged
Patna High Court CR. MISC. No.54911 of 2021(2) dt.07-12-2021 2/2 on provisional bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Nawada in Narhat Police Station Case No. 280 of 2018 on the following conditions:- Petitioner would deposit the loan amount of Rs.3.5 lacs to the aforesaid bank in six months from the date of his release in three equal instalments.
If the petitioner fulfills the condition, his provisional bail would be confirmed by the Court below itself, otherwise the Court below would take steps for cancellation of bail. (Prabhat Kumar Singh, J) shashi/- U T
