JUSTICE SANJAY PRIYA ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in C2/262/2016 for the offence under Section 47(a) of Bihar Excise (Amendment) Act, 2016.

It has been submitted on behalf of the petitioner that the name of the petitioner has been disclosed by Subodh Kumar who was apprehended by the police with motorcycle keeping two gunny bags containing 51 liters of Nepali liquor. The apprehended Subodh Kumar told that the petitioner and one Ranjit Kumar are owner of the aforesaid wine.

It has further been submitted that co-accused Ranjit Kumar has already been granted anticipatory bail by a coordinate

Patna High Court Cr.Misc. No.10674 of 2017 (3) dt.17-03-2017 2/2 Bench of this Court vide order dated 20.12.2016 passed in Cr. Misc. 53675 of 2016.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with C2/262/2016 he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
