Petitioner apprehends her arrest in Sirdala P.S. case no. 12 of 2018 instituted for the offence under Section(s) 409, 420,468 and 471/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner never jointed the aforesaid post as mentioned in the written report on the basis of the document which is said to be forged. In the written report it is alleged that T.E.T. pass certificate filed by few candidates were found to be forged and, accordingly F.I.R. was directed to be lodged against three selected teachers of Sirdala Block as alleged in the written report.
Patna High Court Cr.Misc. No.14877 of 2018(3) dt.02-05-2018 2/3 It is mentioned in para 11 of the bail petition that she has never jointed on the aforesaid post.
Case diary has been received. Learned APP after perusing the case diary has submitted that petitioner never joined on the aforesaid post on the basis of the document as alleged in the written report and did not receive any remuneration. In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Sirdala P.S. case no. 12 of 2018, she shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Vth, Nawada, subject to the conditions as laid down under Section 438(2) Cr. P. C.
