JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Azam Nagar P.S. Case No. 24 of 2017, registered under Sections 341, 323, 324, 307, 354, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that on the joint prayer of petitioner and the opposite party no. 2, who are the husband and wife, the matter was referred to the Mediation Centre, Patna High Court, where the petitioner and the opposite party no. 2 have submitted that they have settled their dispute out side the court and also submitted the copy of the compromise petition filed in the court below for settlement of dispute in terms
Patna High Court Cr.Misc. No.9691 of 2017 (5) dt.04-10-2017 that both parties will lead their independent life on taking divorce, which would appear from the photo copy of compromise petition attached with the Mediator's Report dated 22.09.2017. Having regard to the facts and circumstances of the case and also in view of the compromise petition attached with the Mediator's Report dated 22.09.2017, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Katihar, in connection with Azam Nagar P.S. Case No. 24 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
