JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04/ 21.06.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bachhwara P. S. case no. 26/2018 registered under sections 302 and 201 of the IPC.

Petitioner is own brother of the deceased whose dead body was recovered from a river. Informant is not an eye-witness of the occurrence and according to the prosecution case, deceased was killed inside her house. Admittedly, none has seen the actual killing of the deceased. The place, where the dead body was found, was at a distance of about 9 K.M. from the house of the petitioner. Submission on behalf of the petitioner is that

No.28990 of 2018 (4) dt.21-06-2018 deceased was missing from her home and the petitioner being brother of the deceased made attempt to search her along with his villagers but could not succeed and subsequently, dead body of the deceased was recovered. Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate VI, Begusrai in Bachhwara P. S. case no. 26/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
