JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-09-2021 As prayed for, let the learned counsel appearing for the petitioners remove the defect(s), as pointed out by the office, within four weeks of starting of the Court proceeding in physical mode in normal course.
Heard learned counsel for the petitioners and the learned A.P.P. for the State through Video Conferencing. The petitioners apprehend their arrest in connection with Kotwali P.S. Case No. 57 of 2019, registered under Sections 420 and 406/34 of the Indian Penal Code. The accusation is that Navinta Devi, wife of Sudama Pandey, executed the deed of agreement in favour of informant, Sanjay Kumar Shrivastava to sale the land of Plot
Patna High Court CR. MISC. No.2227 of 2021(2) dt.10-09-2021 2/3 No. 27 area 22 1⁄2 decimals at the rate of Rs.8,00,000/- per Katha on 03.11.2017 and on the same day, she also executed the deed of agreement in favour of Neeraj Kumar (petitioner no.1) to sale the land. Later on, Navinta Devi and her son, Ajay Kumar took cash of Rs.23,00,000/- through cheques and cash but in spite of repeated request, she did not execute the sale deed. Learned counsel for the petitioners submits that petitioners are not named in the FIR but it would appear in the FIR that Neeraj Kumar (petitioner no.1) has also obtained deed of agreement in his favour made by Navinta Devi but in course of investigation, suspicion has been raised against Neeraj Kumar (petitioner no.1) as architect of the whole story and the name of Amit Kumar (petitioner no.2) has also surfaced as architect of the story being the friend of Neeraj Kumar (petitioner no.1). Further submission is that petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial
