The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 457/380 of the Indian Penal Code.
Some unknown persons committed theft and took away some house hold articles from the house of the informant. The suspicion is there against the petitioner and others as they were seen near the boundary wall of the informant. Submission is that the petitioner has no criminal antecedent and nothing has been recovered from the house of possession of the petitioner.
Considering the nature of allegation and the materials,
Patna High Court Cr.Misc. No.3064 of 2017 (2) dt.17-02-2017 2/2 let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari/ Successor Court in connection with Motihari Muffasil Police Station Case No86 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
