JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-06-2022 At the outset, Mr. Kaushal Kumar Jha, learned senior counsel assisted by Mr. Amish Kumar, learned counsel representing the petitioner informs this Court that during pendency of this application the petitioner and opposite party no. 2 have entered into a compromise whereunder they have settled their matrimonial dispute and the issue of alimony to the opposite party no. 2 amicably and an agreement to that effect has been executed which has been filed on the records of Maintenance Case No. 139 of 2016 in the court of learned Principal Judge, Family Court, East Champaran, Motihari. In view of the aforesaid submission a prayer has been made that the petitioner would not press this application if this Court only directs the learned Principal Judge, Family Court to consider the compromise filed by the parties, record their statements and pass an
Patna High Court CR. REV. No.47 of 2021(3) dt.24-06-2022 2/2 appropriate order thereon as early as possible. Ms. Gulnar Begum, learned A.P.P. for the State is present. In the nature of submissions no notice need be issued to opposite party no. 2.
This Application is disposed of with a direction to the learned Principal Judge, Family Court, East Champaran, Motihari to consider the compromise petition, if any filed on the records of Maintenance Case No. 139 of 2016 and pass an appropriate order thereon after giving opportunity of hearing to both the sides in accordance with law within a period of two months form the date of receipt/communication of this order.
Let it be recorded that this Court has not gone into the merit of this case as Mr. Jha, learned senior counsel has not proceeded with the matter in view of the compromise said to have been executed between the parties.
This application stands disposed of with the aforesaid observations and directions.
