The petitioners apprehend their arrest in Tarabari P.S. Case No. 69 of 2016 instituted for the offence under Sections 448, 384 and 504 of the Indian Penal Code.
It has been submitted on behalf of the petitioners that both parties are agnates. There is allegation in the written report that accused persons wanted to grab the land of the informant and they gave threat to the informant of his life and also make demand of rangdari.
From perusal of the written report itself, it appears that there is land dispute between the parties. There is general and
Patna High Court Cr.Misc. No.9610 of 2017 (2) dt.07-03-2017 2/2 omnibus allegation against the petitioners. It is mentioned in paragph-3 of the bail petition that the petitioners have no criminal antecedent.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today, in connection with Tarabari P.S. Case No. 69 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Shri Sanjeev Kumar-II, the learned Additional Chief Judicial Magistrate-V, Araria, subject to the conditions as laid down under Section 438
