JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 354 and 354A of the Indian Penal Code.

The prosecution case is that on 19.2.2016 at about 4 O'clock the informant and three others went for cutting grass when the petitioner came, caught hand of the informant and assured that he will keep her in a better condition. On alarm being raised, the petitioner escaped from the scene and threatened the informant not to be safe in future.

It is submitted by the learned counsel for the petitioner that the petitioner has been roped in the present case since after the death of the father of the informant the petitioner and mother of

No.20122 of 2016 (2) dt.06-05-2016 2/2 the informant, after performing love marriage, started living as husband and wife when there was a dispute with regard to withdrawal of money. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the relationship between the petitioner and informant's mother and statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Katihar in connection with Dandkhora P.S. Case No.16 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
