At the outset, the learned counsel appearing for the respondent- Bihar State Housing Board, Patna has submitted that no defence quota Flat is vacant for allotment to the petitioner, however, whenever such Scheme is floated, the case of the petitioner would be considered on priority. In such view of the matter, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Bihar Soldier Welfare Board, Patna, as and when the Flats under the defence quota are made available by the respondent- Bihar State Housing Board, Patna. Liberty so sought, is granted.
