Petitioner apprehends his arrest in a case registered under Sections 493/313 of the Indian Penal Code. Informant Suhani Kumari in his written complaint has stated that her residence was in front of the residence of Laljee Yadav (petitioner) who was residing in the house of his elder father for reading. Petitioner first of all developed his friendship with her and on promise of marriage with her made physical relation for last three years and she became pregnant and thereafter petitioner aborted her pregnancy by administering

Patna High Court CR. MISC. No.42465 of 2019(5) dt.03-12-2019 2/2 medicine and also demanded Rs. 5,00000/- otherwise he will not perform marriage with her.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Informant is major girl and petitioner is leading conjugal life with the informant peacefully. It has been further submitted that both are living together as husband and wife with full honour and dignity. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Mahila P.S. Case No. 06 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (S. Kumar, J) veena/- U T
