2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 175, 409 of the Indian Penal Code.
3. It is alleged that in spite of direction of District Program Officer, Education Department, petitioner did not provide the folder of merit list of selected teachers.
4. It is submitted that on 31.06.2015 one Birendra Kumar Pandey superannuated from the service and thereafter petitioner was posted in the Gram Panchayat Hardevchak. Birendra Kumar Pandey handed over charge to this petitioner on 02.01.2016 and in support the same annexed documents vide Annexure-2 and 3 to the supplementary affidavit. From perusal
Patna High Court CR. MISC. No.45893 of 2023(3) dt.24-08-2023 2/2 of Annexure-2 and 3, it is apparent that petitioner was not in possession of the folder neither the same was handed over to him by his predecessor.

Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XIII, Bhagalpur in connection with Ishipur Barahat P.S.
