JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 306 of the Indian Penal Code.
The prosecution case is that the sister of the informant committed suicide on 17.02.2016 by hanging herself. It is alleged by the informant that his sister was in love with the petitioner and petitioner promised to marry with her but subsequently when the parents of victim got ready for the marriage, the petitioner refused to perform marriage as a result of which the victim committed suicide.
It is submitted by the learned counsel for the petitioner that there is no cogent material to the effect that the petitioner abated the offence and only on suspicion the accusation has been
Patna High Court Cr.Misc. No.20578 of 2016 (2) dt.13-05-2016 2/2 levelled. No suicidal note has been found to suggest that the petitioner abated the offence. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, in view of this court, it is a case for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioner surrenders within six weeks from today in connection with Siwan Town P.S. case No. 136 of 2016 pending before learned Chief Judicial Magistrate, Siwan.
