JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 21.06.2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Supaul P. S. case no. 126/2018 registered under section 366A/34 of the IPC.

Informant claims that his minor daughter was kidnapped by FIR named accused persons including petitioners. In course of investigation, some witnesses vide paras 7, 8 and 9 stated that victim was in love with one Rajesh Kumar Kamat and she eloped with the aforesaid Rajesh Kumar Kamat.

Learned counsel for the petitioners submits that in

Patna High Court Cr.Misc. No.28203 of 2018 (3) dt.21-06-2018 course of investigation, statement of mother of the victim was recorded vide para 6 of the case diary and she, too, admitted this fact that her daughter was in love with Rajesh Kumar Kamat.

No doubt, victim has not been recovered as yet but considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul in Supaul P. S. case no. 126/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
