JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-05-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 147, 148, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code.

Allegation, as per F.I.R., against the petitioners is that petitioners no. 1 and 2 are named in the F.I.R. and so far petitioners no. 3 and 4 are concerned, there is allegation that they are order giver and there is also allegation against petitioner no. 4 for the offence under Section 379 IPC.

Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that they have falsely been implicated in the present case due to village rivalry. No specific allegation is there against the petitioners.

Having heard both sides, in view of the facts and circumstances stated above, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to the satisfaction of learned SDJM, Sheikhpura, in connection with Ariyari P.S. Case no. 26 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the investigation and make themselves available before the police as and when required.
