The petitioners seek bail in Forbesganj P.S. Case No. 254 of 2018, instituted for the offence under Section 380 of Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Md. Mahfooz who has already been granted bail by coordinate Bench of this Court vide order dated 25.9.2018 passed in Cr. Misc. 43581 of 2018.

Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria, in connection with Forbesganj P.S. Case No. 254 of 2018, subject to the condition that both the bailors will be close relatives of the petitioners.
