The petitioner who is in custody since 06.04.2019 has filed the instant application for grant of bail in connection with Bishanpur P.S. Case No. 18 of 2019 registered for the offence punishable under sections 302 and 34 of the Indian Penal Code. As per the allegation in the FIR, three persons including this petitioner and one Kamal Sahni are said to have assaulted the husband of the informant as a result of which he died.

It is submitted by learned counsel for the petitioner that the case of the petitioner stands on a similar footing of the other two co-accused Kamal Sahni and Lankesh Sahni who have already been granted bail vide order dated 19.04.2019

Patna High Court CR. MISC. No.41610 of 2019(3) dt.12-09-2019 2/2 passed in Cr. Misc. No.24952 of 2019. The petitioner has no criminal antecedent and is in custody since 06.04.2019. The application for bail was opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the fact that the other similarly coaccused persons have been granted bail and the petitioner having no criminal antecedent, is in custody since 06.04.2019, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Chief Judicial Magistrate, Darbhanga in connection with Bishanpur P.S.
