====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-12-2022 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioners is directed to remove the defects within four weeks.

Petitioners apprehend their arrest in a case registered for offence punishable u/s 147, 149, 341, 323, 379, 307, 504, 506 of the IPC.

Allegedly, the accused persons named in F.I.R. including the petitioner assaulted the informant's family by means of lathi.

Patna High Court CR. MISC. No.45275 of 2022(2) dt.01-12-2022 2/3 They also threatened the informant to compromise the earlier case otherwise to kill him. Petitioner nos. 3 & 5 are armed with lathi and snatched jewellery.

It is submitted by learned counsel for the petitioners that petitioners are quite innocent and has committed no offence. They have been falsely implicated in this case. There is general and omnibus allegation against the petitioners and only with a view to save their own skin the informant has lodged the present case against the petitioners. No such occurrence, in the manner as alleged, has ever taken place. It is further submitted that there is case and counter case between the parties and both the parties have received injuries which are simple in nature. Petitioner nos. 2 & 4 have no criminal antecedent while petitioner nos. 1,3 & 5 have one criminal antecedent each. Learned APP for the State opposed the prayer for bail.

Having regard to the facts and circumstances of the case, since the injuries are simple in nature, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.
