JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-02-2021 Heard the learned counsel for the petitioner and Ms. Anita Kumari Singh, the learned APP for the State. The petitioner seeks regular bail in connection with Yogapatti PS case no. 458 of 2019 instituted for the offences punishable under Sections 385, 387 of Indian Penal Code.

The allegation is regarding Rs. 20 lacs having been demanded from the petitioner by way of extortion money by means of mobile no. 7681823039.

The learned counsel for the petitioner has submitted that the petitioner is innocent, has been falsely implicated in the present case and is languishing in custody since 19.02.2020. The learned counsel for the petitioner has further submitted that the aforesaid mobile number does not

Patna High Court CR. MISC. No.40361 of 2020(2) dt.02-02-2021 2/2 belong to the petitioner herein, as has been stated in paragraph no. 8 of the present petition.

Per contra, the learned A.P.P. for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the materials available on record as also considering the fact that the petitioner has stated, in his petition that the aforesaid mobile number does not belong to him, apart from considering the period of incarceration of the petitioner herein, I deem it fit and proper to enlarge the abovenamed petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti PS case no. 458 of 2019.
