2. The petitioner apprehends his arrest in Mady Nisedh P.S. Case No. 524 of 2023 corresponding to Special Case No. 552 of 2023, registered for the offence punishable under Sections 30(a), 32(3) of the Bihar Prohibition and Excise Act, 2016.

3. 5 litres of country made liquor has been recovered from the Scooty of this petitioner.

4. It is submitted that petitioner has falsely been implicated in this case. Nothing has been recovered from conscious possession of this petitioner.

5. Counsel for the State vehemently opposed the bail

Patna High Court CR. MISC. No.45862 of 2023(2) dt.10-08-2023 2/2 application and submitted that recovery has been made from the Scooty of this petitioner and petitioner has got criminal antecedents of similar nature.

6. Considering the fact that recovery has been made from the Scooty of this petitioner and petitioner has got criminal antecedent of similar nature, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
