Learned counsel for the petitioners is directed to remove the defects within four weeks.

The petitioners apprehend their arrest in connection with Mahila P.S. Case No.62/2021, registered for the offence punishable u/s 341, 323, 376, 354(C), 420, 504, 506 & 509 of the Indian Penal Code & Section 4, 8 & 12 of POCSO Act, 2012 & Sections 67, 67 (B) of the I.T. Act.

The allegation against the petitioners is that they being the wife and daughter of co-accused Rakesh Kumar Singh, helped him in various ways to torture the informant mentally

It is alleged that Rakesh Kumar Singh committed rape upon the victim and thereafter used to blackmail her by showing obscene photographs. He defamed the informant by putting false statements on social media applications. It is also alleged that the said Rakesh Kumar Singh committed monetary frauds in the name of informant, in which the petitioners helped him by forging their identity. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. Petitioners have no criminal antecedent.

Learned counsel for the petitioners further submits that the petitioners have no role in the present case. Learned counsel for the petitioner further submits that the petitioners are the wife and daughter of the coaccused Ramesh Kumar Singh. There is no specific overt act against the petitioners. The specific allegation is against the accused Ramesh Kumar Singh. Learned counsel for the petitioners further submits that the victim has sold the land in question and payment was also made to the victim. Learned counsel for the petitioners further submits that prior to this case, the husband of the petitioner no.

Patna High Court CR. MISC. No.55367 of 2021(9) dt.07-11-2022 3/3 the victim under section 138 of N.I. Act and summon was issued. Thereafter, the present case was filed by the victim. It is further submitted that earlier the victim has also filed one Rupaspur P.S. Case No.412 of 2020, in which, she has narrated different kinds of stories.

Learned APP for the State as well as learned counsel for the informant opposed the prayer for bail and submits that entire family of co-accused Rakesh Kumar Singh is involved in the alleged offence of committing forgery with the victim. It is further submitted that in the case diary, there is ample evidence against the petitioners.

Considering the nature of allegation, I am not inclined to enlarge the petitioners on bail. The prayer for grant of anticipatory bail on their behalf is hereby rejected. This application is accordingly dismissed.
