Heard learned counsels for the petitioner and the State.

The petitioner is languishing in custody since 14.06.2014 in a case registered for the offences punishable under Sections 395, 120B and 412 of the Indian Penal Code. Accusation is of robbing Rs.1,75,000/- and Nokiya mobile of the informant. Recovery has been made from the possession of the brother of the petitioner. It is submitted by learned counsel for the petitioner that neither there is any recovery from the petitioner nor

Considering the fact that the petitioner has not been put on TIP, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 252 of 2014.

Considering the criminal antecedent of the petitioner, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
