Petitioner is not named in the first information report and his name transpires in course of investigation. The perusal of the impugned order of learned Addl. Sessions Judge reveals that no specific overt-act has been attributed against the petitioner rather it is stated that petitioner committed the offence in furtherance of common object.

Admittedly, having similar allegation one co-accused Mushaphir Sahani @ Mushaphir Sahni has already been granted privilege of bail by a bench of this court vide order dated 29.8.2014 passed in Cr. Misc. no. 25602/2014.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
