The petitioner apprehend his arrest in Katoriya P.S. Case No.137 of 2009, registered for the offences punishable under Sections 498(A), 323, 302 and 34 of the Indian Penal Code.

The petitioner and the sister-in-law of the deceased are said to have killed the daughter of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. It is further submitted that the daughter of the informant and the petitioner are living together, as stated in paragraph-11 of the bail application. It is lastly submitted that

Taking into consideration the fact that the petitioner and the daughter of the informant are living together, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Katoriya P.S. Case No.137 of 2009, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure with further condition that one of the bailors shall be the informant of the present case.
