The petitioner is aggrieved with the letter no. 4 dated 04.01.2022 issued by the Medical Officer In-Charge, Primary Health Center, Simri Bakhtiyarpur, Saharsa which came to be passed in compliance with the Letter No. 3059 dated 31.04.2018 issued by the Special Secretary, Health Department, Bihar wherein a list of 15 non-functional ASHA Workers were

Patna High Court CWJC No.10798 of 2025(2) dt.15-07-2025 2/3 prepared and the name of the petitioner was also included at Serial No. 4.

3. Learned Advocate for the petitioner submitted that the removal of the petitioner is not based upon any report or the material evidence which suggest dereliction of duty of the petitioner. For redressal of the grievance, the petitioner has also approached the District Magistrate, Saharsa, but to no respite till date. Referring to the materials available on record, learned Advocate for the petitioner further contended that if the representation of the petitioner shall be considered in the light of the materials produced before this Court, there is every chances that the petitioner shall get justice.

4. Learned Advocate for the State submitted that since the grievance of the petitioner is only confined to the disposal of the representation, hence, he has no objection.

5. Considering the fact that the representation was filed long back in the year 2022 and now three years have been lapsed, this Court does not find any reason to interfere in the writ petition, however, the petitioner shall be at liberty to file a fresh representation before the District Magistrate, Saharsa. If the same is done, the District Magistrate shall consider the representation of the petitioner and dispose of the same in

6. The writ petition stands disposed off.
