Petitioners apprehend arrest in connection with Rajpur P.S. Case No. 21 of 2017 registered for the offences alleged under Sections- 341, 323, 379, 385, 384/34 of the Indian Penal Code and section 27 of the Arms Act. Learned counsel for the petitioners submits that petitioners have falsely been implicated in the present case. This case is counter blast of Rajapur P.S. Case No. 22 of 2017 lodged by wife of petitioner no. 1. Injuries have been found to be simple in nature. During investigation, witnesses have denied the allegation of firing and demand of Rangdari.

Patna High Court Cr.Misc. No.16540 of 2017 (2) dt.19-05-2017 2/2 Learned Addl. P.P. appearing for the State opposes the prayer for bail of the petitioners particularly of petitioner no. 2 on the submission that there is direction allegation of assault against him.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner nos. 1, 3 and 4, above named, in the event of arrest or surrender within a period of four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Rajpur P.S. Case No. 21 of 2017 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.

As regards prayer for anticipatory bail of petitioner no. 2, Binod Kumar Vidyarathi @ Vinod Kr. Vidyarathi, considering the nature of allegations levelled against him the same is, hereby, rejected.
