2. This criminal appeal has been filed against the order dated 09.06.2023 passed by Exclusive Special Court SC/ST Act, Patna in connection with Bihta P.S. Case No. 34 of 2023, registered under Sections 341, 323, 325, 504/34 of the Indian Penal Code and Section 3 (i)(r)(s)/3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and Section 27 of the Arms Act, whereby the prayer for anticipatory bail of appellant has been rejected.

3. As per prosecution case, this appellant along with other accused persons is alleged to have dragged the informant from the car and assaulted him with lathi as a result of which

Patna High Court CR. APP (SJ) No.3177 of 2023(3) dt.01-09-2023 2/2 right leg of the informant got fractured. Appellant has got one criminal antecedent.

4. Considering the gravity of accusation, nature of injury and criminal antecedent, I do not find any ground to interfere with the order of the learned court below and as such, the appeal, which has been filed for grant of anticipatory bail is, hereby, rejected.
