2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 420/467/468/34 of the Indian Penal Code.

3. As per the prosecution case, these petitioners, in connivance with officials of concerned Circle office, prepared forged genealogical table showing father of the informant dead unmarried and then obtained compensation from the Land Acquisition Department.

4. Learned counsel appearing for the petitioners

Patna High Court CR. MISC. No.49165 of 2024(5) dt.09-01-2025 2/3 submits that the present case has been lodged in the background of land dispute between the parties and just to put pressure for the share of land. In this connection, Title Suit No. 199/2021 and 129/2023 have also been filed by petitioner no.1 before the Court of Sub Judge I, Pupri, Sitamarhi. Petitioners are no way concerned with creation of alleged Certificate No. 293 dated 21.11.2019 which was later on cancelled by the Circle Officer vide Memo no. 160 dated 29.3.2023, though, on cancellation of certificate no wrongful loss was caused to opposite party no.2.

5. Learned counsel for the State and opposite party no.2 oppose the prayer for bail. They submit that petitioner no. 1 and 2 Raguvansh Prasad Verma and Kailash Prasad Verma respectively have sworn affidavit in support of the certificate and have thus fraudulently received Rs.55 lacs as compensation of the land of opposite party no.2. Family certificate no. 293 dated 21.11.2023 which was cancelled by Anchaladhikari, Pupri after finding Umesh Prasad Verma married with Indraprabha Devi, who is alive and they have one son who is informant of this case. These facts have come in paragraphs 2, 5, 6 and 7 of the case diary. Opposite party no.2 has filed counter affidavit. Petitioners have got criminal antecedent as many as 6 criminal cases are pending against them.

6. Considering the nature of accusation and criminal antecedents of the petitioners, prayer for bail of these petitioners is rejected.
