The petitioner apprehends his arrest in Bhabua (Sonhan) P.S. Case No.170 of 2018 registered under Sections 307, 379 and other Sections of the Indian Penal Code. Ramlal Bind alleged that Bandhu Bind entered into his house and tried to take away a bag containing Rs.30,000. When the informant objected, Bandhu Bind assaulted him with khanti on his head. In the meantime, Jogindra Bind, the petitioner, Surahi Devi, Tetari Devi and Anil Bind came there and assaulted the informant with stick. The accused persons also assaulted the wife of the informant.

The learned counsel for the petitioner submits that no specific allegation of assault is made against the petitioner.

Patna High Court Cr.Misc. No.22890 of 2018 (3) dt.17-05-2018 Bandhu Bind is alleged to have assaulted the informant with khanti on his head. The informant got three injuries out of which one injury was found abrasion on left foot. The same injury opined to be grievous on account of fracture. It is further submitted that there is counter version being Bhabua(Sonhan) P.S. Case No.171 of 2018.

Taking into consideration that no specific allegation of assault is made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua(Sonhan) P.S. Case No.170 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
