JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2018 Petitioners apprehend their arrest in connection with Khagaria (Gangaour) P.S.Case No. 861 of 2017 registered for the offences punishable under Sections 341, 323, 307, 448, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act. Petitioners are named in the FIR and allegation against one of the accused persons is that he fired but did not hit anybody. Submission of learned counsel for the petitioners is that there is case and counter case between the parties and there is general and omnibus allegation against the petitioners. Heard learned APP, who has opposed the prayer for anticipatory bail stating that petitioner No.1 Manoj Singh has criminal antecedents but the same has not been mentioned in the petition.

No.22624 of 2018 (3) dt.26-06-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioners Nos. 2 and 3, named above, in the event of their arrest or surrender be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Gangaur) P.S.Case No. 861 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned. So far petitioner No.1 Manoj Singh is concerned, he is directed to surrender within a period of six weeks from the receipt of this order and make prayer for regular bail, which shall be considered on its own merit.
With the above observation, this application is disposed of.
