The petitioner seeks bail in connection with Jamo Bazar P.S. Case No. 171 of 2020 for the offence under Sections 272, 273, 308, 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner rather the alleged recovery has been made from the co-accused, Kamendra Ram, and the petitioner has no concern with the alleged recovery. The petitioner is rotting

Patna High Court CR. MISC. No.3161 of 2021(2) dt.17-06-2021 2/2 in judicial custody since 14.10.2020.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned 2nd Additional District and Sessions Judge- cum- Special Judge, Excise, Siwan in connection with Jamo Bazar P.S. Case No. 171 of 2020.
