The petitioners are apprehending their arrest in connection with Rafiganj P.S.Case No.45/2019 , registered for offences punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.

Prosecution story is that while the informant was cultivating his field, the accused persons including the petitioner came and the petitioner no.1 assaulted Ramesh Paswan- cousin of the informant by lathi, petitioner no.2 assaulted the informant by lathi and the petitioner no.3 assaulted the cousin of the informant by Khant. Submission of the learned counsel for the petitioners is

Patna High Court CR. MISC. No.42821 of 2019(2) dt.12-07-2019 2/2 that there is case and counter case and the land dispute is also between the parties and further the injuries are simple in nature.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Rafiganj P.S.case No.45/2019, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
